With Halloween approaching, I thought it was fitting to share some scary tales from my experiences in law firm ownership—stories that might send a chill down your spine but, hopefully, save you from similar nightmares! Over the years, I’ve seen firsthand how easily things can go awry, and each of these “scary stories” holds lessons to help keep your firm running smoothly. Here are a few that you may want to keep in mind.

1. When Your Team Becomes Your Competition 👿

Years ago, I encountered what many law firm owners fear most: the prospect of a breakaway law firm formed by our own team. It’s one thing to lose an associate here and there, but when multiple attorneys and support staff plan an exit to start their own competing practice, it can feel like a ticking time bomb for your firm’s revenue and reputation.

The Lesson: Building a great team comes with risks. If you don’t have a strong culture, clear career paths, and a solid compensation structure, you might be preparing your own competition. High-performing attorneys need a reason to stay. If they feel stagnant or undervalued, you may end up facing a devastating wave of departures—and the financial hit that follows.

The Fix: Protecting your firm from a breakaway requires ongoing investment in culture, retention, and growth. This means regularly reviewing compensation to remain competitive, creating defined paths for career advancement, and maintaining a positive workplace environment where attorneys feel valued. A robust, sustainable marketing plan is also critical; it keeps client acquisition high, giving your team confidence in the firm’s stability and future. Building these foundations helps prevent the allure of “breaking away” and positions your firm as a place they want to stay.

2. The “Vanishing Clients” Mystery 👻

In one of my newer practices, we had everything we thought we needed: over 100 qualified leads per month, strong conversion rates on consults, and a seasoned intake team. Yet, despite these numbers, clients weren’t retaining, and we were losing cases left and right.

The Lesson: High lead volume is great, but it’s what happens afterward that matters. In this case, our consult-to-client conversion was the issue, not the lead volume. After implementing consultation training and closely monitoring our intake team’s approach, retention improved, and we turned things around.

The Fix: Regularly track consult-to-client conversion rates. If you notice a dip, start by reviewing the client journey and consider consultation training. Each step in the process should engage and reassure your clients, reinforcing their decision to work with you.

When I hired my first associates over 20 years ago, they were bogged down with non-billable tasks, burning out as they juggled admin work, case management, and client communication. This “curse” of overwork lowered billable hours and, worse, led to frustrated staff.

The Lesson: Doing everything yourself—or expecting associates to wear too many hats—leads to inefficiency and can hold back your firm’s growth.

The Fix: Bring in specialized support staff to alleviate non-essential duties and automate tasks with technology. Hiring a legal assistant or paralegal can create immediate value by freeing up attorney hours, allowing you to scale faster and retain top talent. Using automation tools like Lawmatics, Clio, and Zapier can also streamline workflows maximizing your team’s efforts.

4. The “Phantom Marketing Budget” 🧛

Years ago, I made the mistake of keeping our marketing budget fixed all year long—missing out on key seasonal client acquisition opportunities. This “phantom budget” error prevented us from capitalizing on the most active months for family law.

The Lesson: Failing to adjust your marketing spend to match seasonal client patterns means missing out on prime opportunities for growth or over-spending during quiet periods.

The Fix: Review your lead flow data to identify peak seasons for your practice area, and scale your budget accordingly. I’ve seen huge returns from aligning our marketing spend with data-driven trends, allowing us to maximize client acquisition and revenue potential in high-demand periods.
